Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026
The employers have the obligation to provide all employees, and these to receive, the training or the instruction in their work that allows them to raise their standard of living, their labor competence and their productivity, in accordance with the plans and programs formulated, by mutual agreement, by the employer and the labor union or the majority of the employees.
To comply with the obligation that corresponds to them under the preceding paragraph, employers may agree with employees that the training or instruction be provided to them within the same enterprise or outside it, through their own personnel, specially contracted instructors, specialized institutions, schools or bodies, or else by adhering to the general systems that may be established.
Institutions, schools or specialized bodies, as well as independent instructors that wish to provide formation, training or instruction, as well as their teaching personnel, must be authorized and registered by the Ministry of Labor and Social Welfare.
The courses and programs of training or instruction, as well as the programs to raise the productivity of the enterprise, may be formulated with respect to each establishment, one enterprise, several of them, or with respect to a determined industrial branch or activity.
The training or instruction to which this article and other related articles refer must be provided to the employee during the hours of their working day, except where, attending to the nature of the services, employer and employee agree that it may be provided otherwise; as well as in the case in which the employee wishes to train in an activity different from the occupation they perform, in which case the training shall take place outside the working day.
