Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026

Employers have the following special obligations:

I.To provide comfortable and hygienic accommodations on board;

II.To provide healthy, abundant and nutritious food to the employees of vessels dedicated to high-seas and coastal service and to dredging;

III.To provide lodging and food when the vessel is taken to a foreign port for repairs and its conditions do not permit remaining on board. This same obligation shall continue in a national port when it is not the place where the employee was taken on. The lodging and the food shall be provided at no cost to the employee;

IV.To pay the costs of the remittance of funds to the family members of the employees, when the vessel is abroad;

V.To grant the employees the time necessary for the exercise of the vote in popular elections and in the processes of revocation of mandate, provided that the safety of the vessel permits it and its departure at the fixed date and time is not hindered;

VI.To permit the employees to be absent from their labors to perform commissions of the State or of their labor union, under the same conditions to which the preceding section refers;

VII.To provide food and lodging, medical treatment and medicines and other therapeutic means, in the cases of illnesses, whatever their nature;

VIII.To carry on board the personnel and healing material established by the laws and provisions on communications by water;

IX.To repatriate or transfer to the agreed place the employees, except in the cases of separation for causes not attributable to the employer; and

X.To inform the corresponding Port Captaincy (Capitanía del Puerto), within twenty-four hours of having been declared free pratique, of the work accidents occurring on board. If the vessel arrives at a foreign port, the report shall be rendered to the Mexican consul or, in their absence, to the captain of the first national port touched.
