Article 250 Federal Labor Law

TITLE SIX. Special Jobs · CHAPTER V. Railway work

Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026

The circumstance that the employees, by force majeure, remain isolated from their superiors is not a cause of termination of the employment relationships for cause nor of loss of the rights, if they continue in their posts.

If under the same conditions they abandon them, they shall return to occupy them upon the disappearance of the causes that motivated the abandonment. In these cases, the respective investigations shall previously be made, with the intervention of the representatives of the labor union and of the company, and if from them responsibility results for the affected employees, or it is proven that they voluntarily neglected or harmed the interests of the company, they shall be separated from their employments. The employees who have occupied the abandoned posts shall have the category of interim employees, and upon the reinstatement of the holders they shall continue working in the employments that they previously had or in those that remain vacant.
