Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026

The parties may also request that the directors, administrators, managers and, in general, the persons who exercise functions of direction and administration in the enterprise or establishment, as well as the members of the board of the labor unions, be summoned to answer interrogatories or answer questions personally, when the facts that gave rise to the conflict are their own and have been attributed to them in the claim or answer, or when by reason of their functions they must be known to them.

The appearance of the persons answering the interrogatories referred to in the preceding paragraph for the production of their confessional evidence at the trial hearing shall be the responsibility of the legal attorney-in-fact of the employer party, unless he demonstrates a justified cause that prevents it, in which case the court shall summon them through a court officer.

The judge may reject the confessional evidence or questioning regarding facts proper to the person answering who is intended to appear in the proceeding, when:

a)The hypotheses provided in the first paragraph of this article are not met;

b)It is overabundant or it involves persons answering the interrogatories whose confession or statement deals with the same facts;

c)When the facts on which it is intended that he testify are implausible in the judge's judgment, and

d)His appearance is unnecessary or its production may cause an undue delay of the proceeding.
