Article 489 Federal Labor Law

The following does not release the employer from liability:

I.That the employee explicitly or implicitly had assumed the occupational hazards;

II.That the accident occurs due to clumsiness or negligence of the employee; and

III.That the accident is caused by the imprudence or negligence of a co-worker or of a third person.
